Potential Lawsuit Over PEBP’s “Extended Health Exchange”

I just got this via e-mail. It’s about the State of Nevada forcing its Medicare retirees into the “Extended Health Exchange”.

Reducing or potentially eliminating retiree health benefits started several legislative sessions ago.

“Former legislator Roger Bremner and former Budget Director Judy Sheldrew (you may remember her as Matteucci) are pursuing a lawsuit against PEBP and the State of Nevada for removing the Medicare Retirees out of the PEBP Plan and into the Extend Health Exchange. Judy is now an attorney in Minden, NV. Her legal research leads her to believe the move is in violation of the contracts clause of the Nevada Constitution (Subsection 15, Article I). Similar lawsuits removing or reducing benefits from retirees have been won in California and elsewhere.”

“The AFSCME Retirees and RPEN are both considering supporting this lawsuit. The estimated cost of the lawsuit is $50,000. The plan is to seek a summary judgement since facts are not in dispute; only a question of law.”

“One thought is a donation of $10, $15 or $25 from enough retirees might go a long way to financing this lawsuit. While many may find the move to the Medicare Exchange is not as bad as they thought it would be, the real question is what happens down the road? When PEBP and the Legislature decides to no longer provide the $150 or $200 a month subsidy and leave Medicare Retirees to fend for themselves with nothing more than Medicare.”

    Wow!!!! I thought I was the only one having problems with Extend Health. They sent me a notice that they overpaid me $2200.00 and that I must pay they back or my account will be canceled. Here I thought retirement was going to be easy

    How do I find out more about this law site?
    Extended Health has short changed my account by $600.00 and I am have a hard time getting any kind of an answer from them.

    re potention lawsuit regarding PEBP and Extend Health. Just found this website and don’t know where to direct the incompetent assistance from Extend Health. Obviously, Extend Health isn’t the place; in fact, they REFUSE to do anything in writing–everthing has to be done on the phone and advise is not only not good but never timely. Also, I would be willing to contribute to the law suit–who would I contact?
